Haiti - Justice : Paralysis of criminal assizes in Petit-Goâve

Friday, August 5, 2016, Me Emmanuel Tataille, the Dean of the Court of First Instance (TPI) of Petit-Goâve, wrote to Me Jules Cantave, President of the Superior Council of the Judiciary (CSPJ), asking him to intervene with the Bar of Petit-Goâve for a happy ending of the paralysis, since 28 July, by lawyers of the bar, of a criminal session without jury assistance started on July 25, which had to treat 85 cases.

The Dean of TPI says in his letter that "[...] according to the statements of the said lawyers, this work stoppage would come from the fact the CSPJ refuses to grant permission to the Dean's Office to proceed with the swearing in of Me Alcide Laguerre as Government Commissioner near the Court of First Instance of Petit-Goâve.

The lawyers do not intend to move from their position and claim right and left the swearing in of Me Alcide Laguerre as Government Commissioner.

The Dean, in his minor quality, would appreciate the CSPJ done, urgently, its intervention with the Bar Association of Petit-Goâve, that, for a happy ending to this crisis [...]"

Besides this correspondence, 45 lawyers of the Bar reiterated in a petition they sent to the CSPJ their unconditional support for the appointment of Me Alcide Laguerre and ask the CSPJ to authorize the swearing in of Me Alcide Laguerrenamed "Commissioner" by the Government.

Our correspondent informs us that on Friday at around 10:00 am some advocates of the bar of Petit-Goâve have hardened their claim movement in favor of the installation of Me Alcide Laguerre. They proceeded to the closing of the doors of the prosecution and the court of first instance of Petit-Goâve "Lawyers protesters have used, instead of arguments, of books of law and procedural rules, hammers and nails to close with a rare violence the doors of the city's Procuratorate."
