Haiti - FLASH : 2nd victory of the diaspora against Trump and the expulsion of Haitians !

US Federal Judge William F. Kuntz of New York, in a 145-page detailed ruling issued on April 11, 2019, a temporary injunction at the national level preventing the US Department of Homeland Security (DHS) from terminating the TPS (Temporary Protected Status) of some 50,000 Haitians living in the United States.

This decision is the conclusion of the Saget vs. Trump federal lawsuit in quashing the Trump administration's decision to terminate the TPS as of July 22, 2019.

In his decision Kuntz said that if legal protection for Haitians ended and they were forced to return to their country where security was not guaranteed, tens of thousands of Haitians and their children born in the United States United would suffer "irreparable harm", pointing out that the evidence shows that the Trump Government's decision was motivated by "a discriminatory purpose of expelling non-white immigrants from the country..."

Judge Kuntz clarified that he could not issue a final injunction because the delay granted by the US Government had not yet expired.

Remember that the TPS program, which was supposed to end on July 22, 2019, was extended on March 1 until January 2020 by the DHS https://www.haitilibre.com/en/news-27066-haiti-flash-diaspora-victory-against-trump-the-dhs-extends-the-tps-for-haiti.html to respect the preliminary injunction order issued on October 3, 2018 granted by Judge Edward Chen of the District Court of the Northern District of California, as part of an action brought by immigrants from 6 TPS-recipient countries including Haiti, which temporarily prevents the Trump administration from expelling immigrant beneficiaries.

It is expected that the Trump Government will appeal this decision...
