Haiti - FLASH : A 4th adviser of the CSC/CA yields to the pressures

Members of the Together Against Corruption (Ensemble Contre la Corruption - ECC) organization have visited the Superior Court of Accounts and Administrative Disputes (CSC/CA) to learn about the working conditions of Councilors and Court staff.

Pierre Volmar Demesyeux, the President of the Court and two counselors painted a very dark picture of the security conditions in which members of the Court function, characterized by threats, intimidation and assassination attempts.

They indicated that a 4th adviser, under threat pressure, had left the Court, bringing to 4 the number of Councilors who fled to safety, at least 2 of whom are abroad, refraining from communicating their identities for security issues.

ECC believes that these threats are part of a strategy put in place by people indexed in the audit reports on the management of PetroCaribe funds and that they aim to make the Court dysfunctional to prevent it from issuing "arrêts de débet". Recall that the investigating judge has the legal obligation to wait for a "arrêts de débet" of the CSC/CA before opening an investigation on an accountant of the funds of the State.

The President of the Court has indicated that these intimidations will not prevent the case from taking its course and the counselors promise to release soon the debut of "débets" to allow the justice to begin to do its work.

A "arrêts de débet" is taken in the cases of management of public funds irregular, in accordance with Article 19 of the decree of November 23, 2005 relating to the organization of the CSA/CA which stipulates "The decision which engages the financial responsibility of Accountant in of law or of fact either by finding embezzlement, embezzlement, theft or concussion or by reporting acts prejudicial to the public treasury or to the financial interests of the local authorities or the autonomous organizations, takes the title of 'arrêt de débet'"
