Haiti - FLASH : Victory against Trump, Haitians under TPS get 365 days of stay

Friday, November 1st, the Department of Homeland Security (DHS) announced a Federal Register notice extending the validity of TPS-related documentation for beneficiaries under the Temporary Protected Status (TPS) designations for El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan through Jan. 4, 2021.

DHS is extending the TPS

documentation in compliance with the preliminary injunctions
of the U.S. District Court for the Northern District of California in Ramos, et al. v. Nielsen, et. al. and the U.S. District Court for the Eastern District of New York in Saget, et. al., v. Trump, et. al., and with the order of the U.S. District Court for the Northern District of California to stay proceedings in Bhattarai v. Nielsen.

The notice automatically extends the validity of Employment Authorization Documents; Forms I-797, Notice of Action; and Forms I-94, Arrival/Departure Record (collectively, TPS-related documentation). The validity dates for the affected countries are:

New validity dates :

El Salvador, Haiti, Nicaragua and Sudan

Current Expiry Date: January 2, 2020

New expiry date: January 4, 2021

Honduras:

Current expiry date Jan. 5, 2020

New expiry date Jan. 4, 2021

Nepal:

Current Expiry Date March 24, 2020

New expiry date Jan. 4, 2021

With this new victory in the courts, the 50,000 Haitian beneficiaries of the TPS, are granted a 365-day reprieve by the Trump administration to get in order to not to be expelled from the United States after the expiration of this new reprieve. During this period and as long as they comply with the TPS requirements, the Haitians concerned can not be deported and may obtain employment authorizations.
