Haiti - Justice : Investiture of the members of the Commission for the implementation of Penal Reform

On Thursday, July 25, 2024, Prime Minister Garry Conille, accompanied by Edgard Leblanc Fils, President of the Transitional Council (CPT), participated in the Investiture ceremony of the members of the Penal Reform Implementation Commission.

The ceremony took place at the Villa d'Accueil, in the presence of the Presidential Advisors, Prime Minister Garry Conille, the President of the Court of Cassation Me Jean Joseph Lebrun, the Minister of Justice Me Carlos Hercule, the Dean of the Court of First Instance of Port-au-Prince, the Representative of the Port-au-Prince Bar, members of the Diplomatic and Consular Corps and the representative of the United Nations Integrated Office in Haiti (BINUH).

The 9 personalities from the judicial sector making up the Commission for the Implementation of the Penal Reform : Enex JEAN-CHARLES (President), René MAGLOIRE, Jean Joseph EXUMÉ, Pierre Richard CASIMIR, Patrick PIERRE-LOUIS, Father Kenel SÉNATUS, Wando SAINT-VILLIER, Mrs. Youdeline CHERIZARD and Rubain A. JOSEPH, will be tasked with evaluating the Decrees of March 11, 2020 relating to the Penal Code and the Code of Criminal Procedure and making the necessary recommendations and proposals around the best strategy to adopt for their effective implementation.

In his speech, the President of the CPT Edgard Leblanc Fils declared "[...] You will undoubtedly reformulate, remove or contextualize the controversial articles in order to satisfy the maximum number of sectors of national life so that finally, after 189 years, the country can have a penal code and a code of criminal procedure that take into account offenses related to globalization.

Confident in your skills and professional experience, I am counting on you to implement the two codes within the time limit in accordance with the requirements of the Order. To achieve this, the progress reports will prove useful. The Government will provide you with all the necessary means to achieve the overhaul of our two codes while silencing the protests that have marked each attempt at implementation [...]"
