Haiti - Justice : The new Government Commissioner resigns

The separation of three powers and the establishment of rule of law in Haiti, seem illusory. The career of a Government Commissioner is precarious, whose duration is measured in days or weeks ... Whether it is to dare the fight against corruption, to try to audition a parliamentarian or simply to want to enforce the law and the right, none of this is possible without jeopardizing its position.

Me Lionel Bourgoin Constant, the new Commissioner of the Government, in office since December 5, 2011, presented yesterday Saturday, his resignation to the Minister of Justice, Pierre Michel Brunache, following the attempt of Me Thierry Mayard-Paul, the Minister of Interior to prevent Friday, Gaillot Dorsinvil, former President of the Provisional Electoral Council (CEP) to leave the country and the refusal of the Commissioner to make the arrest of the latter [in the absence of mandate to this effect].

Me Bourgoin considers that the restrictions that the government wants to impose to the members of the CEP violate their freedom and rights, adding "We must get rid of old practices which consist to arrest people for everything"

I have the regret to present you my resignation as Commissioner of the Government at the Court of First Instance of Port-au-Prince. Since I assumed office on Monday, December 5, I continually acting on behalf of the society to ensure the proper application of the law and the respect of public order, this, for an effective public action and respectful of individual liberties.

Because of my deep convictions and fully aware of the extent of my missions, I can not be the armed wing of any power of authoritarian inspiration eager to establish its order.

With on your understanding, I ask you, Mr. Minister, to accept my resignation.
