Haiti - Justice : Unwarranted search of the residence of Port-au-Prince Mayor Ralph Youri Chevry

Following a nearly three-hour search of his residence, conducted without a warrant or explanation, the Mayor of Port-au-Prince, Ralph Youri Chevry, issued the following statement:

"I hereby confirm that an intervention took place today at my residence in Juvenat, between 6:00 and 7:00 a.m. I was awakened by gunshots when my dog ​​was unjustifiably killed.

Statement by Mayor Ralph Youri Chevry :

"Me Fritz Patterson Dorval, the Government Commissioner of Port-au-Prince, accompanied by several armed men wearing uniforms from various units of the Haitian National Police, including specialized units, violated my home in an intervention for which I was not formally notified.

At this time, no warrant has been presented to me. One of my security agents was arrested and then released in Delmas. During this operation, no charges were brought against me.

Following the operation, the PNH weapons assigned to my security detail were confiscated. These included a Galil AC 22 (Taurus), a T4, an AR-15, as well as a communication radio, ammunition, and a surveillance drone.

I would like to remind you that, according to Article 24.1 of the 1987 Constitution, 'the home is inviolable. No search may be conducted except by law and in accordance with the procedures it prescribes.'

Furthermore, under the Code of Criminal Procedure, any search must be authorized by a competent judge, accompanied by a reasoned warrant, and executed in the presence of witnesses. This necessitates legal clarification regarding the absence of a warrant and formal notification, in accordance with the principles of the rule of law.

I cooperated calmly and responsibly, respecting the institutions, while acknowledging the specific circumstances of this operation.

I reaffirm my commitment to the rule of law, respect for legal procedures, and transparency. I also remain devoted to my hometown, Port-au-Prince, and to my beloved country, Haiti.

Any necessary clarification will be provided through appropriate channels, in consultation with my legal counsel.

I urge respect for the established facts to avoid any confusion or manipulation."
