Haiti - Politic : The Senate Commission will not have the passports of the Executive!

The General Secretariat of the Council of Ministers informs that the Council of Ministers met Monday, February 13, 2012, at the National Palace in Port-au-Prince, under the chairmanship of Joseph Michel Martelly, President of the Republic, assisted by the Prime Minister Dr. Garry Conille. During this meeting, the Council adopted the draft Finance Bill 2011-2012 and the Bill on the National Fund for Education.

Furthermore, to the questions of general interest, the Council has considered the convocation to Parliament of Members of the Government in order to submit some paperwork, including the passport and thus demonstrating their unique Haitian nationality, as part of the investigation of the Senate Commission responsible for the verification of their nationality.

The Council of Ministers :

1. Considering that the detention of some administrative documents, including the passport, can not be the irrefutable proof of possession of a single nationality ;

2. Also bearing in mind that the Civil Status and the ability of people is a prejudicial question under the common law court ;

3. Recalling that the President of the Republic has already submitted all his documents considered conform to the law by the Provisional Electoral Council and that, for his part, the Prime Minister has already submitted all his documents considered conform by commissions of the Senate and the House of Deputies during the ratification process ;

4. Referring to the fact that the Parliamentary Commissions have visited the various services concerned of the Public Administration and were able to verify the citizenship of the Members of the Executive power ;

5. Recognizing that the the Legislative Power has the prerogative to investigate any matter considered necessary and that it is free to pursue its investigations with relevant services,

has decided that its members refrain from submitting the documents requested, unless, that by court order, it is otherwise ordered.
