Haiti - Justice : The Ministry of Justice has transfered of judges without the approval of CSPJ

According to Me Jean Renel Sanon, the Minister of Justice, the transfers of Deans of courts of first instance of Les Cayes and of Coteaux, fall within the framework of the consolidation of the judicial system. The Minister deplores in effect the behavior of certain magistrates, who are sometimes complicit in some cases. He intends purify the system and proceed with the necessary changes.

While the approach is commendable, Me Max Elibert, who sits as a representative of Judges to the Court of Appeal to the Superior Council of Juridical Power (CSPJ) informs the Minister of Justice, that these transfers without the consent of the CSPJ, are made in violation on the law. Reacting to the statements of Me Max Elibert, the Minister said, that this is a matter of administrative order perfectly consistent, which falls within the prerogatives of the Ministry saying, "If anyone says otherwise, that it proves it [...]"

An opinionnot shared by Me Durin Duret, President of the Association of Haitian Magistrates (ANAMAH), who denounced Monday the behavior of the Minister who has proceeded to some transfer of Judge of Peace in several jurisdictions in the country. Me Durin Duret ecalls that the Ministry of Justice, is no longer entitled to transfer judges since the inauguration of the CSPJ "Since I am the President of ANAMAH, I find that each time, that we are approaching elections, the executive branch seeks to control the judiciary [...]"
