Haiti - FLASH : Justice adopts a protocol concerning deported Haitian criminals 29/07/2025 10:00:12
On Monday, July 28, 2025, as part of the new measures taken by the U.S. administration for the arrest, deportation, or extradition of Haitian nationals for their participation in financial crimes, or for their complicity in crimes committed by terrorist groups on Haitian territory, https://www.haitilibre.com/en/news-45387-haiti-flash-deportation-measures-against-legal-permanent-haitian-residents-in-the-united-states.html Patrick Pélissier, the Minister of Justice and Public Security, announced in a memo the adoption of a protocol for the processing of cases of Haitian nationals deported or extradited for financial crimes or complicity in the criminal activities of terrorist groups. Protocol adopted for the processing of each case : "Art. 1 - Any Haitian national deported or extradited from the United States or any other country and accused of committing or attempting to commit financial crimes in Haiti, or accused of supporting, financing, advising, or directly or indirectly assisting criminal or terrorist groups in their crimes in Haiti, shall be handed over, immediately upon arrival on Haitian soil, in good condition, to the Government Commissioner. Art. 2 - Any Haitian national deported or extradited on the charges cited shall be held under the orders of the Government Commissioner, either in the premises of the Central Directorate of the Judicial Police (DCPJ) or in any other detention facility appropriate to their case and situation. Art. 3 - The Government Commissioner shall, without delay and with diligence, prepare the file of the deported or extradited individual and refer it to the investigating office. Art. 4- Throughout the investigation of the case, the Government Commissioner will forward any newly discovered evidence to the investigating office. To this end, he will request the support of all financial control institutions (UCREF, ULCC, BAFE, IGF, etc...), as well as any legal or natural person likely to provide it with additional information, in accordance with the provisions of the Code of Criminal Procedure and the laws governing the handling of these offenses.
