Haiti - Politic : Late Reactions of Senator Steven Benoît...

The Senator Steven Benoît declared Friday that he had informed the President Martelly at the meeting of September 4 that the Senate had been "misled" and that 3 judges were misnamed at the courts of cassation "We said that Anel Alexis Joseph is 72 years old, and the article 51 of the law on the status of the judiciary, saidit necessary to have a maximum of 65 years to appear on the list before the Senate," on the other hand, the Senator also stressed "there are two persons who have been appointed to the Court of Cassation on which we have not voted [Me Frantzy Philémon, Government Commissioner at the Court of Cassation and Me Kesner Michel Thermézi, Substitute of the Government Commissioner at the Court of Cassation] they were not on the list, they are competent, they are qualified but they were not on the list [...] we have been misled, we have all the minutes of votes, all documents [...] the Commission Justice will meet and study the documents and we will release a draft resolution that we will submit for vote to the Assembly Monday [...] to say to the President to return to the same list of 18 to take two other people [...]" Responding to the reporter's question if in summary, the Senator Benoît asked the Head of State to intervene in the Courts of Cassation to arrive at the CSPJ (change of Anel Alexis Joseph, President of the Supreme Council) the Senator responded "exactly".

The intervention of Senator Benoit raises more questions that it provides answers. Be "misled" on obvious fact is hardly credible. How the Senate Committee on Justice, in which seat the Senator Benoît, did not see after investigation, the age of the President of the Court of Cassation..? Especially, that on 31 August 2012, the Senator Youri Latortue, President of the Senate Committee on Justice and Security, had indicated the rejection of 5 judges candidates whose the exclusion of Me Thiers Malette (79 years old) who had the retirement age... Why the senators, especially Steven Benoît, did they not see and reacted during the installation of 4 judges to the Court of Cassation, on February 17, 2012, that 2 Judge did not appear on the list of 18 submitted to the President Martelly ? Why did it take seven months to raise this point..? The installation of judges was made publicly, and it is difficult to explain that Steven Benoît have not seen at this time, what today seems him so obvious ? At least at the time, there was an agreement between the Senate and the Executive regarding these installations, what does not tell us the Senator Benoît.
